Brexit left hundreds of members of the cross-border community from Gibraltar living in Spain without public healthcare

All EU nationals living on the Spanish side of La Verja who signed an employment contract with a Gibraltar company after 31 December 2020 are in a situation health exemption in Spain from 1 July 2022. These were the disastrous consequences that Gibraltar’s departure from the European Union (EU) had for a large group of cross-border workers who had to use Personal sanity despite the fact that the Spanish government promised to help them.

This is what lawyers denounce Andrés Gomes Martin, which carries with it the claims of some of these people for free public health care in the Spanish cities where they live. He National Institute of Social Securityexplains Gómez Martín, having just received a claim from one of those affected after nearly a year of silence, which opens the door to possible regulation.

According to data collected from official sources, the Socio-Cultural Association of Spanish Workers in Gibraltar (Ascteg) Since 1987, 15,375 people living in Spain maintain jobs in the Rock and, therefore, cross the Gate at least twice a day. Those who work sporadically or work less than 37 hours a week are not included in this figure, as are those employed by Spanish companies who spend part of their working hours at La Roca as representatives, vendors and transporters. Of the 15,375 cross-border workers, 10,350 are Spanish and 145 are Gibraltarians. The rest (4,880) are foreigners. It is among these that one should look for those affected by the health exclusion caused by Brexit. They are not all, only those who started working after December 31, 2020.

“Government of Pedro Sánchez health care that should be publicly guaranteed for community workers across borders and therefore the right should be recognized for community workers charged to the Spanish public fund, or else retract the statement made”, explained the lawyer, referring to a series of consequences of Brexit triggered after 31 December 2020. So, as a consequence of the UK and Gibraltar leaving the European Union, health agreement reciprocity agreement with EU ends. But so far as Spain was concerned, this measure was mitigated by the bridging measures introduced in accordance with royal decree Brexit from Spain and unilateral agreements retained in Gibraltar. The joint health care agreement was extended to June 30, 2022.

The Spanish government maintained for a year and a half free health to the people of Gibraltar, despite the fact that it should have been extinct by then leave the EU on December 31, 2020. In fact, that day all European countries did it, except for Spain, which drafted the rule. statutory law to adapt its legal system to Brexit.

Spain canceled that extension from July 1 and Gibraltar had to do so too, as he made clear at the time, against his will. Since then, residents of Gibraltar can no longer access free healthcare in Spain during their temporary stay and must ensure that they have a travel insurance with medical cover. Likewise, the Gibraltar Health Authority stopped providing free health care to Gibraltar visitors who are covered by the Spanish Social Security system. Another result is that Gibraltar Revenue Agency stop publishing, starting July 1, 2022, S1 certificate to persons not covered by the EU-UK Withdrawal Agreement who are cross-border workers contributing to Gibraltar’s social security system. It was one of the keys to society being left without health care in Spain. Can they receive health care without an S1?

The day after hearing the news, on June 29, 2022, the Spanish Government sent a message from calm European citizens living in Spain and working in Gibraltar who fear being abandoned free health insurance on the Spanish side of La Verja. As explained by the Sub-delegation of the Spanish Government in the province of Cádiz, none of them cross border workers I will lose him To the Europeans who have signed a work contract in Batu after January 1, 2021 and, therefore, excluded from the Withdrawal Agreement, the Government of Spain guarantees them that it will activate “the necessary mechanisms so that they do not lose their free healthcare coverage in Spain.”

However, all workers across community boundaries have since met administrative silence when they claimed their right to public health care, which had been recognized in writing by the Security Council. Minister of Health And Ministry of Health Junta de Andalucía. In the meantime, they hope the European Commission and the UK conclude an agreement in Gibraltar that will clarify their situation once and for all.
